In accordance with the Digital Millennium Copyright Act (DMCA), it is our policy to respond to notices of alleged copyright infringement and take appropriate actions under the DMCA and other applicable intellectual property laws. This policy outlines how we handle copyright infringement claims.

 

1. Copyright Infringement Notification

 

If you believe that your copyrighted work has been used on RootsTV in a way that constitutes copyright infringement, you may submit a written notification with the following details to our Designated Copyright Agent:

 

- Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

 

- Identification of the material that is claimed to be infringing and that you request to be removed or access to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL or specific location on the RootsTV platform).

 

- Your contact information, including your full name, mailing address, telephone number, and email address.

 

- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

 

- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

 

- Your physical or electronic signature.

2. Counter-Notification

 

If you believe that the material removed (or to which access was disabled) is not infringing, or if you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification to our Designated Copyright Agent.

 

To be effective, your counter-notification must include the following:

 

- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.

 

- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

 

- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are located outside of India, for any judicial district in which RootsTV may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

 

- Your physical or electronic signature.

 

Upon receipt of a valid counter-notification, we may forward it to the party who submitted the original claim of infringement. If that party does not file a court action seeking an injunction against the infringing activity within 10 business days, we may restore the removed material.

 

3. Repeat Infringer Policy

 

RootsTV has a policy of terminating, in appropriate circumstances and at our discretion, users who are deemed to be repeat infringers. We may also limit access to the service or terminate the accounts of any users who infringe any intellectual property rights, whether or not there is repeat infringement.

 

4. Misrepresentation

 

Please note that under the DMCA, any person who knowingly makes a false claim regarding alleged infringement may be subject to legal liability. Misuse of the DMCA process may result in suspension or termination of your account or other legal consequences.

 

5. Changes to This Policy

 

We reserve the right to update or modify this DMCA Policy at any time without prior notice. Any changes will be effective upon posting the revised policy on the RootsTV platform.
